Jahad Rahman partner at Rahman Lowe Solicitors has been featured in the Law Society Gazette as Lawyer in the News. Jahad acted for Radiographer, Sue Allison in a successful claim concerning whistleblowing at the Employment Tribunal in Manchester.
The Tribunal determined that a settlement agreement (which included non-disclosure/confidentiality provisions) she signed without legal advice was unenforceable. Allison had raised concerns about missed cancer diagnoses and standards of care in a breast-screening unit at Morecambe Bay NHS Foundation Trust. Employment Judge Howard concluded at the preliminary hearing that Allison had “an arguable prima facia case” and her employer’s application to strike out her claim on the basis that it had no reasonable prospect of success was dismissed.
She can now press ahead with claims that she was ostracised, blacklisted and subjected to extensive bullying after blowing the whistle in 2012.
